    The White Paper on child sex offenders: “Treatment and diagnostic profile of online sex offenders to the detriment of minors for the prevention of and fight against this phenomenon”.The “White Paper on child sex offenders”, fourth and last stage of the ACSE project, is a series of considerations and suggestions that are the outcome of a process funded by the European Commission. This project came to life in response to one of the priority European calls of a domestic nature: the sexual exploitation of children, illegal use of internet, and cyber‑criminality.Two of the most alarming and less known contemporary phenomena are child pornography and grooming.Child pornography is an exponentially increasing offense and this fact is confirmed by data provided by the Postal and Communications Police.The child pornography offender’s profile does not coincide with that of an average pedophile: they operate outside the family context; are much younger; if intercepted by the police, they end up in jail for a couple of days and penalties tend to be low and do not always enforceable (for example suspended sentences) thereby allowing the subject to avoid entering into a prison circuit, and all the more so, for the sentence to be enforced and often this results in losing trace of the offender.In many cases, the behavior of child pornographers rapidly escalates leading to solicitation and sexual abuse both online and offline, moreover, in order to be accepted in child pornography circuits, they must in turn produce and distribute their own child pornographic material, bringing what could be comparable to a tribal ritual, a sort of “offering”.Grooming is also an increasing offense that is growing exponentially. It is estimated that at least 30% of preadolescents that surf the web have been in contact with this phenomenon. From a legal point of view, in Italy, only with Law N. 172 of October 1, 2012, was the convention issued on October 25, 2007, for the protection on minors against exploitation and sexual abuse of the Council of Europe, ratified and enforced. Implementation of the EU directives regarding the taking in charge of those who use child pornography material and the treatment of abusers has yet to be completed.This White Paper includes different articles by several Italian specialist on this topic, they describe the legal situation in Italy compared to other coutries als Germany, Spain, France and Norway including a complete anasysis of the Italian legislation.

    This project builds on nearly ten years of research, at three different levels of academic study, and aims to answer the following question: 'How have judges presiding over Québec provincial courts interpreted and enforced section 172.1 (Luring a Child) of the Criminal Code of Canada?'The project is designed to provide a more detailed understanding of persons charged under the authority of the Criminal Code’s Luring a Child provision, the circumstances of the offence, and how Québec provincial court judges interpreted this information, rendered related decisions, and, in so doing, enforced this particular area of Canadian criminal law.The proposed postdoctoral project is designed to provide a more expansive understanding of the ICL phenomenon.

    The Law and Freedom Foundation of 'mosque buster' lawyer Gavin Bobby has just published a comprehensive report on the UK grooming gangs. Entitled "Easy Meat – Multiculturalism, Islam and Child Sex Slavery", the report examines in detail; what these gangs do; the chronology of the problem; institutional failure and the abuse of the narrative of racism; the Islamic cultural background and the scale of the problem. The report establishes that 20 years ago childcare professionals dealing with the schoolgirl victims made recommendations which could have protected them, but these steps have never been implemented.

    This briefing on grooming provides valuable insight into the modus operandi of a very sophisticated groomers. It also sets out a number of lessons which can be learnt from these cases and which are applicable and relevant to all organisations working with children. Indeed, the school featured in one of the described cases is eager for the lessons which can be learnt from this case to be shared with the education community more widely.One of the mentioned cases is about William Vahey, who taught at international schools throughout his life. In 2014 he was discovered in possession of a number of abusive images of students, images which it would appear he obtained having drugged students on school trips that he ran. Vahey committed suicide following the reporting of these images to the FBI. It is now known that Vahey's criminal behaviour spanned over 40 years and may have occurred in up to 10 international schools in 9 different countries.

    De rechtbank Midden-Nederland heeft verdachte veroordeeld tot een gevangenisstraf van 48 maanden waarvan 6 maanden voorwaardelijk met een proeftijd van 3 jaren wegens ontucht, mensenhandel, grooming en kinderporno. De rechtbank oordeelt als volgt.“Verdachte heeft zich schuldig gemaakt aan het plegen van ingrijpende ontuchtige handelingen met een aantal minderjarige meisjes, grooming, mensenhandel en het bezit van kinderporno. De slachtoffers waren steeds kwetsbare minderjarige meisjes, waarbij er sprake was van een aanzienlijk leeftijdsverschil tussen verdachte en de meisjes. Door de wetgever is de geestelijke en lichamelijke integriteit van jeugdigen uitdrukkelijk beschermd, onder meer op de grond dat zij op seksueel gebied nog niet volgroeid zijn en dat zij worden geacht niet zelfstandig de emotionele gevolgen van seksueel contact voldoende te kunnen overzien. Handelingen zoals de verdachte die heeft gepleegd, vormen een ernstige inbreuk op de lichamelijke integriteit van de slachtoffers en kunnen, naar de ervaring leert, leiden tot blijvende psychische schade. Dat ook bij de slachtoffers sprake is van psychische schade blijkt, naast hun verklaringen in het dossier, uit de ter terechtzitting besproken onderbouwing van de schadevorderingen en de slachtofferverklaringen. Hieruit wordt duidelijk dat de slachtoffers nog steeds op verschillende manieren last hebben van hetgeen hun is overkomen. Verdachte heeft naar het oordeel van de rechtbank op geen enkele wijze rekening gehouden met de mogelijke nadelige gevolgen van zijn handelen voor de slachtoffers. Hij heeft uitsluitend oog gehad voor zijn eigen belang en de bevrediging van zijn eigen seksuele behoeften. Door zijn handelwijze heeft verdachte de lichamelijke integriteit van de slachtoffers in ernstige mate aangetast en hun seksuele ontwikkeling verstoord.”

    This report highlights important developments in several areas of online crime. The changes in the production of malware are increasing rapidly in scale and sophistication. These are producing cybercrime capabilities ranging from simple key logging and theft of sensitive data, to ransomware and sophisticated and complex banking Trojans. Malware is also essential in creating and controlling botnets. Recent developments in the use of peer-to-peer networks to host command and control infrastructure create additional difficulties for law enforcement to disrupt or takedown botnets.Child sexual exploitation online continues to be a major concern with offences ranging from sexual extortion and grooming, to self-produced child abuse material (CAM) and live streaming, which pose particular investigative challenges. Offenders are facilitated by many of the same services and products as typical cybercriminals including anonymisation tools, secure e-mail, bulletproof hosting and virtual currencies.

    Rapid innovations in information and communication technologies facilitate the trafficking in human beings (THB) by exposing a growing number of victims to traffickers. These traffickers use social networks and online classified sites to market, recruit, sell and exploit their victims. The internet has shifted the recruitment, advertising and selling process from the street to the digital domain.Online interaction creates both risks and opportunities for criminals, victims and law enforcement. Criminals and victims leave permanent traces, which facilitates identification, but not necessarily intervention. This gap between identification and intervention is becoming more difficult to overcome for law enforcement. This Intelligence Notification provides an overview of Europol’s knowledge on the role of the internet as a facilitator for THB.

    Research conducted with a number of Barnardo’s services warned that children from good homes are at the same risk of sexual abuse as less fortunate children due to their activities on the internet. The internet and new technologies have allowed potential victims to be accessible and available to perpetrators, who may be anonymous, quickly and freely in ways that would otherwise not be possible. Children and young people at risk of harm online may not have any previous vulnerabilities that are often associated with being victims of sexual abuse and exploitation, such as being in care; from families facing adversities or having a history of sexual abuse. This means that they are less likely to be identified as they might not be known to the authorities. The new report found almost half of young people admitted keeping their parents in the dark about their online activities.

    Het gerechtshof Arnhem-Leeuwarden heeft verdachte veroordeeld tot een jeugddetentie voor de duur van 22 maanden en een PIJ-maatregel voor de duur van drie jaren wegens verkrachting, kinderporno en grooming. Het gerechtshof oordeelt als volgt.“Verdachte heeft door zo te handelen op grove wijze inbreuk gemaakt op de fysieke en psychische integriteit van drie zeer jonge meisjes van respectievelijk 11, 12 en 14 jaar. Hoewel de meisjes expliciet aangaven in de WhatsApp gesprekken dat zij geen seks met hem wilden, dwong hij de meisjes naar de afgesproken plek te komen. Aldaar gaven de meisjes zowel verbaal als non-verbaal aan dat zij geen seks met hem wilden. Het hof rekent het verdachte zwaar aan dat hij desondanks over de (fysieke en psychische) grenzen is gegaan van de meisjes en louter oog had voor (de bevrediging van) zijn eigen lustgevoelens. Daarbij heeft verdachte zich op geen enkele wijze rekenschap gegeven van de mogelijke gevolgen, het welzijn en de eventuele gezondheidsrisico’s voor de meisjes. Verdachte heeft daarnaast geen enkele verantwoordelijkheid genomen voor hetgeen hij heeft gedaan. Gelet op de persoonlijkheid van verdachte zoals hiervoor beschreven acht het hof gronden aanwezig voor toepassing van het jeugdstrafrecht ex artikel 77c Wetboek van Strafrecht. Voor de bewezen geachte feiten is een jeugddetentie van 24 maanden de maximale straf die volgens de wet kan worden opgelegd.”
