Since this report was first released by the International Centre for Missing & Exploited Children (ICMEC) in April 2006, ICMEC has continued to update its research into the child pornography legislation currently in place in the nations of the world to gain a better understanding of existing legislation and to gauge where the issue stands on national political agendas.1 In particular, we are looking to see if national legislation: (1) exists with specific regard to child pornography; (2) provides a definition of child pornography; (3) criminalizes computer‐facilitated offenses; (4) criminalizes the knowing possession of child pornography, regardless of the intent to distribute; and (5) requires Internet Service Providers (ISPs)2 to report suspected child pornography to law enforcement or to some other mandated agency.In the summer of 2009, ICMEC conducted a thorough update of our research on existing child pornography legislation, expanding our review beyond the 187 Interpol member countries to include 196 countries. Our work included independent research as well as direct contact with Embassies in Washington, D.C. to ensure the accuracy of the report.A new review of the 196 countries began in the Spring of 2011. The process remained much the same; reviewing the existing legislation of each country in search of laws specifically focused on child pornography offenses and verifying the information through the Embassies in Washington, D.C., U.N. Permanent Missions in New York, and in‐country law enforcement contacts. However, the 7th edition report also contains several new sections including expanded information on online grooming, information on the new EU Directive on combating the sexual abuse and sexual exploitation of children and child pornography, a review of data retention and preservation policies, and a discussion of implementation.Copyright © 2013, International Centre for Missing & Exploited Children.

Abstract:'Sexting can be a costly activity, particularly for teenagers. As more teenagers engage in sending sexually explicit images to one another, the likelihood of serious long-term consequences increases. When sexting is used as a means to bully, the potential severity of consequences also increases. In many jurisdictions, prosecutors may charge juveniles caught sexting with possession or distribution of child pornography. At the same time, some states have recognized the severity of such a charge and found other ways of addressing the teen sexting problem. This Comment addresses the current issues surrounding juvenile sexting by examining empirical data, legal responses, and legislative reactions. It argues that Washington’s current approach to juvenile sexting is inappropriate and should be amended. It suggests a two-tiered statute that separates non-malicious juvenile sexting from malicious juvenile sexting. The proposed statute, which would punish cyberbullying and malicious juvenile sexting more severely, will allow Washington to effectively deter harmful behavior while taking into account juvenile immaturity.'

This article is about the story of a victim of sextortion, who helped the FBI track down a perpetrator who's made 350 victims. The article states:'It’s called sextortion, in which predators coerce or manipulate someone (often an underage someone) into sending lewd, compromising pictures or videos, many of which are released publicly or traded as child pornography. Although there are no specific numbers for sextortion, it’s on the rise; according to the U.S. Office of Juvenile Justice and Delinquency Prevention, reports of online child sexual solicitation surged 44 percent between 2010 and 2014.'

Abstract:'Online safety for children and adolescents as a policy issue finds itself in a turbulent arena: emerging new mobile and online technologies and applications carry opportunities and risks and constantly bring new challenges. This article explores particularly the field of adolescents and cybercrime against a background of a culture of control combined with an increasing use of new media by youngsters. Based on two particular cases, i.e. 'grooming'—a new development in criminal law where children and adolescents are treated as (potential) victims in need of protection—and 'sexting'—a new development in online risk-taking where adolescents are framed as (potential) offenders in need of repression—we argue that public policy with respect to adolescent behaviour and online risks is tilting towards more control. These developments in cybercrime policy that focus on criminal law as a policy instrument disturb the balance between the freedom of adolescents to develop into responsible and independent adults and controlling online risks. Other, more promising avenues, such as encouraging digital literacy of citizens and protecting those children who are particularly vulnerable, should rather be at the forefront of public policy.'

Another section highlights challenges faced by law enforcement officials and government policymakers in dealing with the online sexual exploitation of children:'A program that addresses all efforts to protect children from online exploitation and coordinates the work of all agencies and organizations working in this field is strongly recommended. There is currently no entity that coordinates or addresses all aspects of the online exploitation of children on a national level.'

This article states that most publicity about online “predators” who prey on naive children using trickery and violence is largely inaccurate:'Internet sex crimes involving adults and juveniles more often fit a model of statutory rape—adult offenders who meet, develop relationships with, and openly seduce underage teenagers—than a model of forcible sexual assault or pedophilic child molesting. The purpose of this article is to provide an accurate, research-based description of the characteristics and prevalence of this high-profile social problem; make recommendations for effective responses; indicate needs for future research; and give professionals basic resources to help manage issues that arise in practice and other contexts.'

The writer of this article states that teens should have the right to 'sext':'This means they would have the same rights as adults to produce sexual images of themselves without fear of prosecution for creating child pornography. The right to sext is also about the right to demand that these images are kept private. While further legal reforms are needed to protect online privacy (for youth and adults), allowing teens the right to sext is the first step in clarifying that eople who receive these images have no right to distribute them further without permission. The panic about sexting teens highlights the need for broader conversations about social media that can fully account for the complicated issues of privacy and consent in new digital media.'
