    This is the English version of the revised and substantially abridged Third Report on Trafficking in Human Beings that was presented to the Dutch government in July 2004. Just as in the First Report, attention will be given to legislation and regulations and the efforts of the police and the Public Prosecution Service in this area. The victims of trafficking will also be considered further, together with those non-governmental organisations and persons that provide them with assistance and represent their interests, such work being of incalculable value. A crucial factor is the awareness that these victims, because of exploitation, have had their human dignity severely impaired and have been forced into a position of subjugation to such an extent that this constitutes a breach of fundamental human rights. Society must act to combat this.

This second report contains supplementary numerical information. It must be seen and read in conjunction with the first report that contains all sorts of background information and is of a more reflective nature. This report presents updated figures together with already published numerical data, in order to show possible trends.

    You have before you the English, somewhat abbreviated, version of the first report of the (Dutch) National Rapporteur on Trafficking in Human Beings. The report, which intends to contribute to an increase in attention to the prevention and combat of trafficking in human beings (THB), was presented to the Dutch government in May 2002. This report indeed particularly concerns Dutch actors, and the Dutch situation, but is presumably also interesting for foreign, or international persons and organisations, who are dealing with the topic as well. This because the report gives an overall picture of the Dutch situation, as far as legislation is concerned, victim support, police investigation and prosecution of perpetrators, and it touches on more general problems and possible solutions as well, in relation to THB. At this it should be pointed out that some of the data, especially the quantitative data, are not entirely up to date. Therefore, the Rapporteur will publish a quantitative update at the end of this year. Sometime at the beginning of 2003, an English version of the update will become available.

    ABSTRACTIn this study, we addressed the need for empirical research on human trafficking by compiling unique data relating to criminal charges filed in federal judicial districts and using these data to examine trends in sex trafficking-related cases, as well as the impact on those trends of the Trafficking Victims Protection Act of 2000 (TVPA). Results from our regression models indicate that the proportion of all charges filed by federal prosecutors that involved sex trafficking and related cases increased significantly between 1994 and 2007. The rate of increase, however, slowed in the time period following the passage of the TVPA, suggesting that the TVPA may have helped to mitigate increases in new cases. In addition, our results show statistically significant inverse relationships between immigration and sex trafficking-related charges filed, providing new evidence to support the possibility that some sex trafficking-related cases may be being prosecuted as immigration cases instead.

    'It is well documented that displacement leads to a considerable increase in human trafficking. The UN Environment Programme has indicated that trafficking may increase by 20-30% during disasters, and INTERPOL has warned that disasters or conflict may increase the exposure of women to trafficking as families are disrupted and livelihoods are lost.3 There are multiple instances in which trafficking has been shown to increase in the aftermath of cyclones, flooding, earthquakes and tsunamis.4 Some of this is for sex trafficking, some of it is for forced labor. We also see a great deal of human smuggling leading to journeys that are perilous and too often fatal.'

    ABSTRACTLos van morele opvattingen rond prostitutie, toont wetenschappelijk onderzoek aan dat prostitutie soms verweven is met criminaliteit. In het geval van uitbuiting en mensenhandel wordt vaak de link gelegd met georganiseerde criminaliteit: criminele organisaties, groepen of netwerken worden verondersteld de handel in vrouwen te organiseren. In deze bijdrage vragen we ons aan de hand van een casestudie te Gent af welke niet-legale activiteiten aanwezig zijn in de prostitutiesector, in welke mate er sprake zou kunnen zijn van georganiseerde criminaliteit en hoe de lokale overheden deze fenomenen aanpakken. Zonder een exhaustief overzicht te willen bieden, identificeren we op basis van analyse van gerechtelijke dossiers en interviews met prostituees en sleutelfiguren sociale fraude en uitbuiting als belangrijke niet-legale activiteiten in de prostitutiesector. Een aantal zaken bemoeilijken de formulering van duidelijke uitspraken over de relatie tussen deze fenomenen en georganiseerde criminaliteit. De aanpak van wantoestanden in de sector blijkt hoofdzakelijk gericht op repressie en in mindere mate op preventie. Verder merken we dat de aanwezige lokale hulpverlening aan sekswerkers voornamelijk om medische redenen wordt gebruikt, en minder om wantoestanden aan te pakken.

    Deze masterproef handelt omtrent ‘loverboys in België’. Zowel in de wetenschap als in de bredere samenleving is de aandacht rond dit fenomeen recentelijk toegenomen. Kranten publiceren steeds meer omtrent dit thema. Ook het wetenschappelijk onderzoek stijgt. Maar aangezien de toegenomen aandacht recent is, is het onderzoek hieromtrent nog beperkt. De doelstelling van dit onderzoek is dan ook om een beter inzicht te verkrijgen in dit fenomeen. Om dit te bereiken worden loverboys vergeleken met het klassieke pooierschap. Een plausibele hypothese is namelijk dat het fenomeen een sociaal construct is. Dit wil zeggen dat ‘loverboys’ mogelijks een term is die ontstaan is uit de ervaring dat het om een nieuw fenomeen gaat, terwijl dit in werkelijkheid misschien niet zo is. Als dit het geval is dan zouden loverboys eigenlijk ‘gewoon’ pooiers zijn. De centrale vraag van dit onderzoek is dan ook wat de overeenkomsten en wat de verschillen van loverboys met pooiers zijn. Een antwoord op deze vraag is relevant voor zowel wetgeving en beleid als voor praktijk.

But there is no limit to what governments, law enforcement, civil society and committed private sector partners can do together.Technology is a force for good. Yet, there is a dark side. Technology also facilitates the exploitation of children and creates enforcement gaps. We have to change that. We have to catch up. We have to innovate. Technology is a central part of the challenge, but I believe that within technology resides the solution.

    It is necessary for States to have adequate legal and institutional frameworks to protect children from sexual exploitation in travel and tourism. Companies that fail to protect children or even violate children´s rights should be held liable. With international law being directed primarily at States, the question of liability for corporate violations has proved difficult. Yet, it is central when considering the role of a child victimised by sexual crimes in tourism.The overall objective of this study is to analyse the existing legal and ‘soft law’ instruments that address corporate liability in the context of sexual exploitation of children in travel and tourism (SECTT). The study also explores the possibility of holding companies liable to international and domestic law and, accordingly, identify gaps and future challenges.
