    De Inspectie van het Ministerie van Sociale Zaken & Werkgelegenheid (SZW) heeft in haar jaarplan in grote lijnen de activiteiten beschreven die de Inspectie in 2016 wil uitvoeren. Eén van de themagerichte programma's die naar voren komt is die van de aanpak van arbeidsuitbuiting. De Inspectie wil met het programma Arbeidsuitbuiting een betere en structurele bijdrage leveren aan de aanpak hiervan in Nederland.Dit gaat de Inspectie onder andere doen door het verzamelen en analyseren van informatie uit de inspecties. Dat moet ertoe moet leiden dat: 'de Inspectie intelligenter kan sturen met kennis en informatie bij de aanpak van arbeidsuitbuiting; risicoanalyses de bestrijding van arbeidsuitbuiting verbeteren; samenwerking bij de aanpak van arbeidsuitbuiting verbetert; en haar capaciteit bij de aanpak van arbeidsuitbuiting slimmer inzet', aldus het jaarplan.

    This manual is the result of the project TeamWork! Strengthening multidisciplinary cooperation against trafficking for labour exploitation, which was set up in preparation for the Netherlands presidency of the Council of the European Union in the first half of 2016. TeamWork! is a joint project with Luxembourg, Slovakia and Malta, which had and will have the presidency in the periods before and after the Netherlands.This manual is aimed at experts and intended to help inspire and strengthen the policy and practice to address trafficking in human beings (THB) for labour exploitation of all organisations that could come across it. More specifically, it aims to stimulate multidisciplinary and cross-border cooperation and a comprehensive approach against this phenomenon. It was drawn up as part of a project called TeamWork!, which was started by four consecutive presidencies of the Council of the European Union (EU): Luxembourg, the Netherlands, the Slovak Republic and Malta. Because of this, the manual mainly focuses on strengthening cooperation among and within EU countries, but it also contains advice on cooperation with third countries.

    Following the establishment of a dedicated task force, the Irish government has issued its Report of the Government Task Force on Non-European Economic Area (EEA) workers in the Irish Fishing Fleet December 2015. The report was instigated in response to The Guardian (November 2, 2015) article raising the issue of trafficked migrant fishermen and in which it revealed that: “African and Asian migrant workers are being routinely but illegally used as cheap labor on Irish fishing trawlers working out of some of the country’s most popular tourist ports.”The report was chaired by Simon Coveney T.D. Minister for Agriculture Food and the Marine in which he stated in the foreword that: “The scheme to allow for the structured and transparent employment of non-EEA workers within a defined framework in the Irish fishing fleet, as set out in this report, has been endorsed by Government. While the issues addressed in the report focus solely on bringing forward recommendations in the Irish context, the potential exploitation of such workers is a global phenomenon and certainly not unique to Ireland.

    This report provides a source of information for practitioners involved in the investigation and prosecution of THB for the purpose of labour exploitation. It elaborates on a number of indicators of ‘labour exploitation’ that have emerged from national case law. Given that THB is very often a cross-border crime, the report also highlights best practice in judicial cooperation as identified through the analysis of Eurojust’s casework. The findings of this report are based on the analysis of (i) 32 judgments from 10 Member States and Norway,4 referred to Eurojust by national authorities when replying to the THB External Questionnaire; (ii) 17 cases registered in Eurojust as THB for labour exploitation; (iii) 29 responses to the THB External Questionnaire; and (iv) the outcome of the Strategic Meeting THB 2015. The analysis of case law does not aim to be exhaustive, given that it relies only on decisions referred to Eurojust in preparation for the Strategic Meeting THB 2015. As well as this, the low number of THB for labour exploitation cases referred to Eurojust does not allow the drawing of firm conclusions and can be considered only as illustrations of possible best practice in judicial cooperation.

    An Examination of Forced Labor and other Human Rights Risks Endemic to the Thai Seafood Sector by Verité.'Seeking to better understand the risks of forced labor and human trafficking in the Thai seafood industry, Nestlé contracted Verité to conduct a focused investigation of six production sites in Thailand—three shrimp farms (one in Mahachai and two in Surat Thani), two ports of origin (Ranong Fish Port and Mahachai Fish Port), and one docked fishing boat (in Ranong Fish Port). These sites were identified by a third-party supply chain mapping consultant as being linked with the fishmeal (or fish feed) used as feed input in farms producing whole prawns for Nestlé. Verité assessed these and a number of other worksites in the same supply chain. The three-month assessment focused on forced labor and trafficking risks in the recruitment, hiring, employment and living conditions of foreign migrant workers in the targeted vessel-to-marketplace shrimp and fishmeal supply chain of one of Nestlé’s key suppliers.'

    This report provides crucial insight into the experiences of these temporary workers in the U.S., the visas most frequently associated with trafficking and exploitation, and the barriers victims face in accessing help. Temporary visa holders often pay large recruitment and travel fees for the opportunity to work in the United States -- and the debts they incur leave them particularly vulnerable to being victimized. Traffickers can control and manipulate these individuals who have few options, lack familiarity with U.S. laws and rights, and face significant language and cultural barriers. The visa rules also frequently restrict their ability to change employers. But there are solutions, including: prohibiting recruitment fees, requiring accurate contracts, modifying data reporting requirements, registration of foreign labor recruiters, and more.

    This article examines the link between restrictive immigration schemes, specifically ‘tied visas’ and the selective application of labour laws, with exploitation of workers. It focuses on the situation of migrant domestic workers, who accompany their employers to the United Kingdom (UK) and are exposed to both an excessively restrictive visa regime, introduced in April 2012, and limited labour protections. The immigration status of these workers is currently tied to a named employer, a restriction that traps workers into exploitative conditions, often amounting to forced labour, servitude or slavery. Additionally, current UK labour laws are either not enforced or not applicable to domestic workers. The article concludes that unless the current immigration regime is abolished and comprehensive labour law protections are extended to migrant domestic workers, exploitation will continue.

    Abstract:Labor trafficking is a form of modern slavery in which individuals are compelled to perform labor or services against their will by means of force, fraud, or coercion. The National Human Trafficking Resource Center (NHTRC) hotline and the Polaris BeFree Textline received 419 reports of likely labor trafficking cases involving traveling sales crews between January 2008 and February 2015, more than any other industry except domestic work. This report analyzes data collected from these hotlines, as well as open source data from legal records, government documents, industry experts, news media, and social media.'

    De verdachte is vrijgesproken van mensenhandel vanwege gebrek aan bewijs. De rechtbank overweegt:'De tenlastelegging in de onderhavige zaak is vooral gebaseerd op de verklaringen van aangever [aangever] , een Roemeense man die niet over een werkvergunning beschikte. De verklaringen die [aangever] heeft afgelegd bevatten indicatoren voor uitbuiting. De rechtbank is echter van oordeel dat [aangever] zo inconsistent verklaart, dat deze verklaringen niet in overwegende mate het bewijs van de uitbuitingssituatie kunnen vormen. De inconsistenties betreffen onder meer de afspraken die [aangever] met verdachte zou hebben gemaakt en de periode waarin hij voor verdachte en andere travellers zou hebben gewerkt. De rechtbank acht aanvullend bewijsmateriaal voor de uitbuitingssituatie daarom noodzakelijk. Op basis van het zich in het dossier bevindende bewijsmateriaal kan echter slechts worden vastgesteld dat [aangever] heeft gewerkt voor een groep travellers, waarvan verdachte deel uitmaakte, en dat [aangever] voor die werkzaamheden betaald heeft gekregen. De rechtbank kan niet vaststellen hoeveel [aangever] betaald heeft gekregen. Dat het te weinig is geweest berust alleen op de verklaring van [aangever] zelf. Ook kan worden vastgesteld dat [aangever] in ieder geval een korte periode in een smerige caravan heeft verbleven. De politie heeft hem daarin immers aangetroffen. Dat hij daar voor langere tijd heeft verbleven, berust wederom enkel op de verklaring van [aangever] zelf. De verklaring van campingbeheerder [getuige 2] kan wat betreft de uitbuitingssituatie niet als aanvullend bewijs worden gezien. [getuige 2] verklaart immers hoofdzakelijk over wat [aangever] hem heeft verteld.'
