    Op 20 juli 2015 moet de richtlijn 2013/32/EU (verder: de Procedurerichtlijn) in de Nederlandse wet- en regelgeving zijn geïmplementeerd. De richtlijn bevat gemeenschappelijke normen waaraan een asielprocedure dient te voldoen. Een van deze normen is dat de rechterlijke toets over de beoordeling van de geloofwaardigheid een volledig en ex nunc onderzoek van zowel de feitelijke als juridische gronden omvat. Het is daarmee van groot belang om de door de IND verrichte toetsing van de geloofwaardigheid zo inzichtelijk mogelijk te maken.

    Op 20 juli 2015 moet de richtlijn 2013/32/EU (verder: de Procedurerichtlijn) in de Nederlandse wet- en regelgeving zijn geïmplementeerd. De richtlijn bevat gemeenschappelijke normen waaraan een asielprocedure dient te voldoen. Een van deze normen is dat de rechterlijke toets over de beoordeling van de geloofwaardigheid een volledig en ex nunc onderzoek van zowel de feitelijke als juridische gronden omvat. Het is daarmee van groot belang om de door de IND verrichte toetsing van de geloofwaardigheid zo inzichtelijk mogelijk te maken. Daarbij zal een ‘integrale geloofwaardigheidsbeoordeling’ centraal staan. Het leerstuk van de ‘positieve overtuigingskracht’ komt hiermee als zodanig te vervallen. Per 1 januari 2015 zal de besluitvorming – voor zover op dat moment nog geen voornemen is uitgegaan - daarom enkel plaatsvinden onder verwijzing naar artikel 31, eerste lid, Vw1, gelezen in samenhang met artikel 3.35 Voorschrift Vreemdelingen (VV).In deze werkinstructie worden de nieuwe afdoeningsgronden (o.a. kennelijke ongegrondheid, niet-ontvankelijkheid) buiten beschouwing gelaten, omdat die niet eerder dan bij de wetswijziging medio 2015 zullen worden geïntroduceerd. Deze werkinstructie komt in de plaats van werkinstructie 2010/14 Beslissystematiek.

    This paper focuses on labour and sexual exploitation faced by Romanian female workers employed in the agricultural sector in Ragusa, Sicily, Italy. Drawing on fieldwork conducted in 2013 and 2014 with Romanian female farm workers in Ragusa, the paper identifies factors that contribute towards their vulnerability to exploitation. By paying specific attention to the experiences of women who are mothers with dependent children, we look at structural factors that increase their vulnerability and consider how this vulnerability ‘forces’ women into situations whereby they effectively accept and/or submit to abuse. We also highlight how European Union (EU) citizenship does not automatically protect migrants from such abuse. This is important because, as we argue, the mistreatment experienced by participants in this study can be regarded as cases of forced labour and trafficking, based on International Labour Organization (ILO) indicators1 and the definition of trafficking provided by the Directive 2011/36/EU. For a long time, these cases have mostly been neglected by incompetent authorities or addressed using only repressive and assistentialist approaches. Thus, this paper also investigates the limits and potentialities of the Italian legal framework on trafficking, and the ways local institutions and organisations confront the rights violations occurring in the agricultural sector. We contend that in order to effectively counter these phenomena, labour rights measures and anti-trafficking interventions have to be combined based on a comprehensive approach aimed not only at assisting victims, but also at tackling the structural factors that create their vulnerability.

    Law enforcement, including the Australian Federal Police (AFP) as the international gateway for information on child exploitation matters in Australia, has experienced an unprecedented increase in the incidence of online child exploitation reporting across Australia over the last several years, challenging the operational resources of all respective agencies. Transnational child sexual exploitation is underreported within many overseas jurisdictions. Cultural barriers and poor levels of community awareness, combined with reliance on the income foreign tourists provide, make many countries in Southeast Asia, in particular, vulnerable to online and travelling child sexual exploitation.

    There are over two million children living in residential care centres, or ‘orphanages’, in the world, although it has been suggested that the real number is likely to be far higher, and possibly as high as eight million. Research has shown that four out of five of these children have at least one living parent and the vast majority could be living with one or both of their parents or with other family members if provided with appropriate support. Despite well-established evidence of the harmful impact of institutionalisation on children’s development and wellbeing, international travellers volunteering in such centres, often with very limited, if any, supervision, continues to be promoted as an acceptable form of tourism and volunteering experience. Children in residential care are already at a higher risk of abuse and exploitation and are exposed to further risk of harm by unqualified and unsupervised international volunteers. In addition, residential care operators can come to see international volunteering and children in their ‘orphanages’ as a key means of income, fuelling the growth of residential care in the country and promoting children’s unnecessary separation from their families.

    Calabash Tours and its NGO partner Calabash Trust are a social enterprise based in Port Elizabeth South Africa. The company uses tourism and volunteer tourism, in particular, as a way of developing poor communities in the townships or urban slums of the city. Calabash Tours is committed to the principles of social, economic and environmental justice. Through our commitment to human rights, we became aware of the issues of child protection within the travel and tourism sector. Upon recognising some of the abuses of children’s rights in the sector, Calabash Tours went about putting its own house in order, ensuring that it upheld child protection standards within the company. What follows is a reflection of the key issues as experienced practically in the area of volunteer tourism.

    This paper provides a snapshot of child sex tourism in a Samoan tourist setting, based on research conducted in 2009 which focussed on the scope, risk factors and underlying causes. The research findings are largely based on interviews with key stakeholders: government and intergovernmental agencies, civil society, urban and rural focus groups and taxi drivers. It includes recommendations for improvements in policy, advocacy and research.

But there is no limit to what governments, law enforcement, civil society and committed private sector partners can do together.Technology is a force for good. Yet, there is a dark side. Technology also facilitates the exploitation of children and creates enforcement gaps. We have to change that. We have to catch up. We have to innovate. Technology is a central part of the challenge, but I believe that within technology resides the solution.
